Welcome to the WBDS Community Portal at community.wbds.live (the "Portal"), operated by Wild Bird DesignScapes, LLC ("WBDS," "we," "us," or "our"). By accessing or using the Portal, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the Portal.

1. Use of the Portal

The Portal provides educational content about native habitat design, bird conservation, native plant resources, live bird cam feeds, community features, and membership services for the Western Main Line region of Eastern Pennsylvania. You agree to use the Portal only for lawful purposes and in accordance with these Terms.

You must be at least 13 years of age to create an account on the Portal. By creating an account, you represent and warrant that you meet this age requirement.

2. Accounts and Registration

When you create an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate your account at our discretion if we believe you have violated these Terms or engaged in conduct that is harmful to other users or the Portal.

3. Membership and Subscriptions

The Portal offers membership tiers with varying levels of access to content, live streams, and community features. Membership fees are billed through Stripe, our third-party payment processor. By subscribing, you authorize us to charge the applicable fees to your chosen payment method on a recurring basis (monthly or annually, depending on your selected plan).

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. We do not offer prorated refunds for partial billing periods unless required by applicable law.

We reserve the right to modify membership pricing or features with reasonable advance notice. Existing subscribers will be notified of any changes before they take effect.

4. SMS Verification

The Portal offers optional phone number verification via SMS. By entering your phone number and requesting a verification code, you consent to receive a one-time SMS message containing a verification code. Message frequency is limited to one message per verification request. Standard message and data rates from your mobile carrier may apply.

SMS messages are used exclusively for account verification purposes. We do not send marketing, promotional, or recurring messages via SMS. You may reply STOP to opt out of SMS messages at any time, or reply HELP for assistance.

5. User Content

The Portal may allow you to submit content, including comments, photographs, and videos of plants, birds, and nature. By submitting content, you grant WBDS a non-exclusive, royalty-free, worldwide license to use, display, and distribute your content in connection with the Portal and our services.

You represent that any content you submit is your own original work (or that you have the right to share it), does not infringe on any third party's rights, and is appropriate for a nature-focused, family-friendly community. We reserve the right to remove any content that violates these Terms or is otherwise objectionable at our sole discretion.

6. Intellectual Property

All content on the Portal — including text, graphics, logos, images, videos, educational materials, and software — is the property of Wild Bird DesignScapes, LLC or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Portal content without our prior written consent.

7. Third-Party Services

The Portal integrates with third-party services including Stripe (payments), Twilio (SMS), eBird/Cornell Lab of Ornithology (bird data), BirdWeather (species detection), and others. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of any third-party services.

8. Disclaimer of Warranties

The Portal is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Portal will be uninterrupted, error-free, or free of viruses or other harmful components. Educational content about native plants, bird habitats, and landscaping is provided for informational purposes only and should not be considered professional horticultural or ecological advice for your specific property without a site assessment.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Wild Bird DesignScapes, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Portal, including but not limited to loss of data, revenue, or profits, even if we have been advised of the possibility of such damages.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Chester County, Pennsylvania.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. When we do, we will revise the "Effective Date" at the top of this page. Your continued use of the Portal after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
